Iredell County Court Records

Iredell County court records are official documentation of court proceedings. The Iredell County Courts are the custodians of these records. These courts play an instrumental role in ensuring that the essence and nuance of the judicial process are carefully documented. Are Iredell County Court Records Public?

Yes. According to the North Carolina Public Records Law, Yes. According to the North Carolina Public Records Law, any person may obtain copies of public records and public information - meaning all papers, records, documents, tapes, books, photographs, data processing records, or other files made or received by the Iredell County Courts in pursuance of public business. However, this provision also states that public agencies are not authorized or required to disclose any confidential information (§ 132-1.2). Information defined as confidential includes:

  • Electronic captured images of a person’s signature, date of birth, driver’s license number and any portion of social security number.

  • Criminal investigation or intelligence information records
  • Information that may pose a threat to the health or safety of the complaining witness
  • Information that may jeopardise prosecution of a defendant or the right of a defendant to a free and fair trial

What Information is Available in Iredell County Court Records?

The information available in Iredell County Records may differ across case types. The contents of a general civil record will differ from those of a criminal record.

Iredell County Civil Court Records

These types of records contain documents relating to non-criminal matters between individuals or corporations.   • Online Access - Researchers can access Iredell County court records online through the North Carolina Judicial Branch Portal. This case management system allows the public to find court records online and also find upcoming hearing dates.
  • In-Person Access - Reviewing court records in-person is the only way to access comprehensive court records for zero search fees. Interested persons may visit the Iredell County Clerk of Superior Court to inspect court records through the Court’s public terminals. These terminals let users search for cases by the party’s name, case number, or names of other persons involved in the case.

Individuals may also submit request forms to obtain paper copies of court records for a fee. However, to find or request copies of court records, the searcher must know and be able to furnish sufficient identifiable information on the record needed to enable staff to locate it. The office is open Monday through Friday, 8:00 AM to 5:00 PM.

  • Mail and Phone Requests - Iredell County Court records can also be requested by mail, with payments made via money order or certified checks. Interested persons should contact the Iredell County Clerk of Superior Court at Phone: 704-832-6600 for further enquiries on the processes and requirements, as they are not available online. Nevertheless, mail requests must bear the name, contact information, and address of the requester, and information about the record needed (case name, case number, filing date, case type).

Fees for Court Records in Iredell County

According to the Iredell County Fee Schedule, the costs of obtaining physical copies and having records produced upon request at the Iredell Courts are $0.25 per page for photocopies, $0.50 - $1 per page for colored printer copies, and $35 - $40 for CD and DVD tapes.

Criminal Records Access in Iredell County

State-level criminal record checks and offender information are the responsibility of state law enforcement agencies in North Carolina and not the Iredell County Courts. However, unlike some other states, North Carolina allows individuals to request personal criminal record checks through the office of their superior court clerk. So, interested individuals may contact the Iredell County Clerk of Superior Court to request state-level criminal history checks

Likewise, criminal case court records are also accessible through the Clerk of the Superior Court’s office. Searchers can even submit record requests online, track the status of requests and payments.

Iredell County Probate Records

The Iredell County Superior Court handles all probate matters for the county. Probate and estate records are filed and maintained for safekeeping by the clerk of the superior court.

Iredell County probate records are documents created by the courts during the administration of a deceased person’s estate. These may include the will, inventory of liabilities and assets, petitions filed by the executors or administrators of the estate to kickstart the probate process, and other court orders. Probate is necessary to ensure that all creditors are paid after the deceased passes and the estate is executed according to will (if they die testate) or the assets will be shared in line with the North Carolina Intestate Succession Act, where there is no will.

Probate courts in Iredell County also handle guardianship, conservatorship, validating wills, appointing executors or administrators of the estate, notifying beneficiaries, et cetera. Probate records may not be available online; interested persons should visit the courthouses to inspect or request records in person or by mail.

Iredell County Family Court Records

The Iredell County Superior Court handles all family law and domestic relations cases within its jurisdiction. Such cases may often include divorce, separation, child rights, termination of parental rights, child support, child neglect and abuse, spousal support, custody, visitation, legal emancipation, adoption and foster care, and other related issues.

Iredell County family court records may be accessed online through the North Carolina eCourts portal. Although researchers may only be able to access case summaries or brief information pages online. Family law cases often involve minors; researchers should expect that a number of these cases may be exempted from disclosure under the NCGA Public Records Law.

Federal Court Records in Iredell County

The federal case jurisdiction for Iredell County is the U.S. District Court for the Western District of North Carolina. Federal offenses committed in Iredell County or federal offenders caught in the county are prosecuted in the federal courts that have jurisdiction over questions of federal law.
